--------------------------
According to Article 18(2) of the DTA, government pensions paid by Switzerland are taxable only in Switzerland, even if the recipient is a tax resident of Thailand.
Legal Basis:
Article 18(2) of the Swiss-Thai Double Taxation Agreement explicitly states:
“Notwithstanding Article 17, pensions and other similar payments paid by, or out of funds created by, a Contracting State (e.g., Switzerland) or a political subdivision or local authority thereof to any individual in respect of services rendered to that State, subdivision, or authority shall be taxable only in that State (Switzerland).”
Since AHV (Swiss Old Age and Survivors’ Insurance) is a state pension, it falls under this provision and is only taxable in Switzerland, not in Thailand.
---------------------------
This statement explains that
Swiss government pensions, including
AHV (Swiss Old Age and Survivors' Insurance), are
taxable only in Switzerland, even if the recipient resides in Thailand.
Key Points:
- Legal Basis:
- Article 18(2) of the Swiss-Thai Double Taxation Agreement (DTA) applies.
- It overrides Article 17, which generally covers pensions.
- It specifically states that government pensions paid by Switzerland (or its subdivisions) are taxable only in Switzerland.
- Implication for AHV Recipients in Thailand:
- Since AHV is a government pension, it falls under Article 18(2).
- Therefore, Thailand cannot tax AHV payments received by Swiss retirees residing there.
- Only Switzerland has the right to tax it.
Conclusion:
If you receive
AHV while living in Thailand, you should
only be taxed in Switzerland, and
Thailand should not impose any tax on your AHV pension based on the DTA.
